RAPTOR ROOFING – TERMS & CONDITIONS

1. Introduction & Scope
1.1 These Terms & Conditions (“Terms”) apply to all visitors, users, and leads of Raptor Roofing (“we”, “us”, “our”, “Raptor Roofing”) via our website (https://raptorroofing.com) or via phone call, lead-form submission, retargeting, and related digital marketing campaigns.
1.2 Raptor Roofing provides roofing inspection, consulting, assessment, and lead generation services. We do not sell roofing materials or perform the physical installation of roofs unless separately agreed in a separate contract.
1.3 By submitting a lead form, calling our phone number, or responding to our marketing outreach, you (“you”, “Lead”, “User”) agree to these Terms.
1.4 These Terms govern the relationship between you and Raptor Roofing regarding the lead capture and service‐facilitation process; they do not constitute a contract for roofing installation (unless a separate contract is executed).

2. Lead Capture, Marketing & Data Use
2.1 We utilize digital marketing channels including but not limited to Google Ads, retargeting networks, and website tracking (including heat‐map analytics) to capture and process leads.
2.2 By submitting your contact information (via form or phone), you consent to us contacting you (via phone, SMS/text, email) and sharing your lead information with our partners, affiliates, subcontractors or clients for the purpose of providing roofing inspection/assessment referrals.
2.3 We may use cookies, tracking pixels, heat‐map software and other analytics tools to monitor website usage, optimize campaigns, improve user experience and evaluate marketing effectiveness. You acknowledge that your browser activity may be tracked for these purposes.
2.4 We do not sell your personal data to unrelated third parties; we share only with service providers or clients for which you’ve submitted a lead or opted in.

3. User Obligations & Representations
3.1 You represent and warrant that all information you provide (name, address, phone, email, property details) is accurate, complete and current.
3.2 You agree to provide access (if requested) to your property for inspection, if applicable, and to safely prepare the site (remove fragile items, grant access to roof/attic/area) if any in-person inspection is scheduled.
3.3 You understand that any inspection or assessment is based on observable conditions at time of visit and data provided; we do not guarantee detection of every defect, nor do we guarantee roof life beyond the manufacturer’s warranty or guarantee.
3.4 You acknowledge that conditions may exist that are hidden or latent (e.g., structural decay, moisture intrusion, previous poor repairs) which may not be discovered until further investigation; you agree to hold us harmless for such undisclosed conditions.

4. Disclaimers / No Warranty on Installation
4.1 Raptor Roofing provides inspections, assessments and lead-generation support only (unless a separate contract for installation is executed). We make no warranty, guarantee or representation regarding any installation performed by third-party contractors or service providers.
4.2 To the fullest extent permitted by law, Raptor Roofing hereby disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
4.3 Any advice, suggestions or referrals we provide are for informational purposes only. You agree we shall not be liable for your choice of contractor, quality of work, or cost overruns.
4.4 We are not responsible for damage, loss or defect related to the roof, property, materials or workmanship of third-party contractors.

5. Limitation of Liability
5.1 To the maximum extent allowed by applicable law, in no event shall Raptor Roofing or its officers, directors, employees, agents or affiliates be liable for any indirect, incidental, special, consequential or punitive damages, including lost profits, loss of use, property damage, or personal injury arising out of or connected with these Terms, lead-generation services, inspections, or any referral.
5.2 Our total aggregate liability under or in connection with these Terms, whether in contract, tort (including negligence), statute or otherwise, shall not exceed the fees (if any) you paid to us (if applicable) in the 12 months prior to the claim.
5.3 The foregoing limitations shall apply even if a remedy fails of its essential purpose.

6. Indemnification
You agree to indemnify, defend and hold harmless Raptor Roofing, its affiliates, subcontractors, officers, directors, employees and agents from and against any and all claims, losses, damages, liabilities, costs or expenses (including attorneys’ fees) arising from your breach of these Terms, your negligence or willful misconduct, or your use of our marketing, referral or lead-generation services.

7. Privacy & Data Security

7.2 You acknowledge and consent that your data may be transferred, processed and stored by us and by our service providers in the United States.
7.3 We implement commercially reasonable administrative, technical and physical safeguards to protect your personal information. However, we cannot guarantee absolute security or protection from unauthorized access or disclosure.

8. Marketing Consent & Calls
8.1 By providing a phone number, you consent to receive calls, SMS/text messages, voicemail messages from us or our service providers and marketing partners, including automated telephone systems, about inspection services, referral opportunities or related information. Message & data rates may apply.
8.2 You consent to the recording and monitoring of phone calls between you and Raptor Roofing for quality assurance, training and compliance purposes.
8.3 You understand that your submission may trigger retargeting advertising across the internet (display, video, social), based on your prior website visit or interaction.

9. Changes & Updates to These Terms
9.1 We may update these Terms from time to time. When we do, we will revise the “Effective Date” at the top and post the updated Terms on our website.
9.2 Your continued use of our services, marketing interactions or lead submissions after the posting of updated Terms constitutes your acceptance of the revised Terms.

10. Termination / Suspension
10.1 We reserve the right, at our sole discretion, to restrict, suspend or terminate your access to our website, lead-forms, marketing campaigns or referral services at any time, for any reason (including breach of these Terms).
10.2 Sections 4, 5, 6, 8, 9 and 11 shall survive any termination of these Terms.

11. Governing Law & Dispute Resolution
11.1 These Terms shall be governed by and construed in accordance with the laws of the State of Indiana without regard to its conflict-of-law provisions.
11.2 Any claim, dispute or controversy arising under or relating to these Terms shall be resolved exclusively in the state or federal courts located in Indianapolis, IN, and you consent to the personal jurisdiction of such courts.
11.3 If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.

12. Miscellaneous
12.1 Entire Agreement: These Terms (together with the Privacy Policy) constitute the entire agreement between you and Raptor Roofing regarding the subject matter herein and supersede all prior agreements or understandings (written or oral).
12.2 No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
12.3 Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms at any time without your consent.
